According to Duck and Cover, Bethesda has surprisingly dropped the appeal in the Bethesda v. Interplay case. Here's a statement from Bethesda's lawyers:

The undersigned hereby moves that the above appeal be dismissed upon such terms as have been agreed to by the parties. FRAP 42(b). Undersigned counsel represents to the Court that all appellate counsel of record consent to this dismissal.

While Duck and Cover and Frymuchan, one of Interplay's investors, speculate that this means the Project V13 can go forward, it is not yet clear. It is, for example, possible that Bethesda paid Interplay money for them to stop working on Fallout Online instead. Hopefully, we will know soon.

Update: Interplay has filed a report on this to the SEC. As it turns out, Bethesda only dropped the appeal to the preliminary injunction. It does not mean that the whole lawsuit was dropped - the legal war very much continues. And war never changes.
