I knew that Bethesda developers were using The Vault wiki as a source when working on Fallout 3. As it turns out, their legal department also does! Shacknews has a few more details about the Bethesda v. Interplay case, and their article includes a few quotes from the actual court filings.

While Interplay claims that they haven't officially announced Project V13 as a Fallout title, Bethesda claims that "V13" is an obvious reference to Vault 13, "both the starting location and the the initial working title of the original Fallout game." Sounds familiar? That's because it's only a slight paraphrase of the following section in The Vault's Project V13 FAQ:

What does "V13" stand for?
It likely stands for Vault 13, which was the starting location in the original Fallout. Vault 13: A GURPS Post-Nuclear Adventure was also the initial working title of what eventually became Fallout.

It's especially evident when you google for "starting location" + "initial working title". And given the fact that it's not exactly correct - it was a working title, but not the initial one.

It also turns out that two days before the Fallout Online licensing agreement allegedly automatically terminated, Interplay sent Bethesda a letter in which it claimed that it is "in compliance with the requirements" with no proof backing it up, and requesting amendment to the agreement (which allowed them to release the game only on PC) to "ultimately launch the FALLOUT MMOG to be compatible with and accessible on both handheld devices and consoles" Bethesda denied this and claims that Interplay failed to gather $30 million and enter "full-scale development," by April 4, 2009, as per the agreement. Interplay's development partnership with Masthead Studios was also allegedly a violation of the contract.

According to Bethesda, Interplay's Fallout Trilogy (US) Fallout Collection (UK) Saga Fallout (Poland) bundles are "confusingly similar to Fallout 3" and "are in direct competition with Bethesda's Goods and cannibalizes on sales of 'Fallout 3.'" Bethesda does not ask for any set sum of money, as lawsuits often do, and instead wants unspecified monetary damage, which include "Bethesda's damages and Interplay's profits...for Interplay's willful violation of Bethesda's registerd trademarks,". In the lawsuit, it is declared that the "continuing use of the FALLOUT Mark without authorization constitutes willful infringement."

By the way, any lawyers here that have access to the full court filings, by any chance?

    Well, they could have used somewhat different wording like "original working title" etc. I doubt that they would come up with *exactly* the same phrases (which don't appear together anywhere else on the web, despite the subject being discussed in lots of places) if they weren't using The Vault for reasearch.

    Actually, the best proof that they used the wiki is that the information is not entirely accurate. "Vault 13" was indeed an early working title, but not the *initial* one.

    personally i think that using an online wiki as a reference to backup any argument is considered invalid...

    as we all know that most online wikis (with the Vault included) can be edited by anyone with an internet connection, so the materials on wikis can be changed to suit particular needs of particular parties.

    I find it funny that the Fallout Trilogy was ok when it was being sold physically, but when it became a downloadable game, it suddenly "jeopardizes Fallout 3's sales (which is a bullshit argument)." Even though Bethesda has total free reign to do this, I think it isn't right and they could've done something about this issue BEFORE THE DAMN THING WAS RELEASED TO THE PUBLIC WHEN IT WAS OFFICIALLY HINTED AT FOR AT LEAST TWO WEEKS BEFORE IT WAS RELEASED.

    I think Bathesda has issue with the term Trilogy is used for the pack when the third fallout is no part of the package. Easy for someone to be confused if they see fallout 3 and then fallout trilogy right next to it for only 20 bucks.

    It's funny you use the term monopolize, at it's root it an economics term. Ya see Bethesda is a company just like any other, they expect other companies to play by the rules. Just because interplay made a very good game a while back does not mean they are exempt from these rules. Since they broke the rules and tried to screw Bethesda out of money, they deserve to suffer all the consequences. They tried to pull some sneaky bullshit and they were caught, this is how the world works. They tried to pull some other shit a while back, turns out THEIR OWN PEOPLE don't appreciate it when their company doesn't pay them. Interplay does not deserve your pity, they are not the saviors of Fallout, and left to their own means they will never produce another Fallout game ever again. Obsidian's "New Vegas" is your best hope for recapturing what you think Interplay can still make. Fallout isn't dead, Interplay is. This is the hard truth, accept it.

    Guys stop, Beth's games are great although I do agree....GIVE PS3 USERS THE FRIGGIN DLCS. No, I play it on PC, but it's not about pleasing Micro$oft it's about pleasing the fan base. No fans = no money.

    Fallout 3 was a heap of shit. Especially compared to the first two games. It was Oblivion with guns, crap story, crap characters... Bethesda make RPG's for people who don't like RPG's. I just hope they don't get their hands on anymore classic PC franchises, considering we're running out of them. Nearly every classic game on PC from the days of yore has been raped by developers like Bethesda for the kiddy console market.

    Excactly. Graphics were awesome, story line was shit.

    The Characters were lifeless and posessed none of the wit, charm and survival needs from the first two games. Actions were almost without consequence. There was only one real town, not much decent trading to be done. Giant titan robot for killing people? come on, lame.

    It was ok as a FPS goes but did not have the spark of life present in the originals. I think Bethesda just have no balls, to scaired to make a real fallout sequel, so we got the sensored version.

    The graphics were realy good tho :)

    First of all, Fallout 3, isn't that enjoyable, and plus it also fished alot of money. Though Broken Steel was good, why add a new DLC, when bethseda could've added it in the original game. It was for money, this is why betheseda sued Interplay, and also, i think Todd Howard was saying something about "I was really pushing everyone to get the rights", or something, and he said it would be really fun to work with this new genre. What he meant to post is, "I was really pushing everyone to get the rights, so we can fish money from the people, you know guys, that isn't a bad idea...." Thats what he meant to say...

    I'm not a Bethesda fanboy but it's Interplay's fault for not fulfilling the contract and it's also Interplay's fault that it had to sell the Fallout franchise due to its own mismanagement.

    Pleasing Fallout fans is an impossible endeavor. If the hand of God came down tomorrow and developed a new Fallout game, the headlines would read "God to develop new fallout title; Fallout fans pissed"

    I like Fallout 1 and 2 as much as the next guy, but people seem to deify them in retrospective. Fallout 1 and 2 were also buggy as hell on release. Try playing them unpatched. But people are willing to overlook that.

    As far as the lawsuits are concerned, they both seem to make sense to me. The Fallout Trilogy pack does seem suspect... trilogy seems to imply a game and its two sequels, not a game, a sequel, and a spinoff...

    Bethesda allowing Obsidian to develop New Vegas is as close to putting it in the hands of the original developers as they can come. Interplay has a tiny fragment of the original Black Isle team. Plus, Interplay doesn't have any money. They're grasping for straws. Chances are Interplay will never publish a Fallout MMO, regardless of how the lawsuit plays out. A couple years back, they were bouncing payroll checks and being forcibly shut down and reopening frequently. Its a joke.

    As it stands, Bethesda is in the right here. They paid money, consideration, for a contract and rights to be acquired by it. Rights Interplay specifically agreed to. Interplay didn't play by the rules on two different occasions and even told Bethesda to it's face that it could do what it wants regardless of the agreement in consideration for V13.

    Sure Bethesda might have taken an argument point from a wiki, but as one person said that doesn't make it invalid. If they took law from a wiki and tried to apply it, then they would be laughed out of court.

    You might hate Bethesda, and you might hate Interplay... It doesn't matter. This is a valid claim between the two that needs to be settled. As for the production of new games or DLC from Bethesda, a lawsuit is not going to stop them. They have the rights and there is no question towards their ability to do so.

    That's the reason for a legal department. That way the other departments can do their job while the lawyers do theirs.

    Bethesda own fallout, just face it. If you buy a loaf of bread from a shop, you're not expected to give some of it back to the shopkeeper to sell again and it's the same principle. People here just complain cause they hate Bethseda for "ruining" fallout. As has been said, the first 2 we're extremely buggy too, and I'm sorry if this sounds naive, but could you really make a game in 2008 that remains the same as it was over ten years before? Bethesda brought the fallout serires into the 21st century. You can't get away with making games with 10-20 locations in as an RPG, not these days. People may say it's too similar to Oblivion, but thats hardly true. Sure, they added a traversable world map and random, non-storyline specific locations, but it's called EVOLVING, all the base concepts are the same as the originals. BIS themselves even began to shift towards realtime combat, as shown in Fallout: Tactics, so this is just the natural evolutionary step. Well, this comments probably gonna get slated nonetheless, but I think people here are just blaming Bethesda for Interplays shortcomings.

    It doesnt really matter does it? u got games like Fallen Earth and Borderlands coming out for god's sake! Stop moaning, groaning, and bitching cause it aint gonna do no good... You wanna vent that frustration, start up fallout 3 or whatever and gun down entire towns. Go out and get, or in this case, pre-order Borderlands and enjoy 1 million weapons and 10 thousand parts for your vehicles! Or play Fallen Earth, and build on your own 95% of everything in the game! Just STOP wasting your energy here!

    Spent the last 20 mins reading this. All I have to say is this: Interplay did something stupid, and as with all things, it has to pay up. Bethsoft, who by the law are in the rights, are doing what any self-resepcting entity would do, and that is taking care of its margins. And to those scumbags who downloaded the game and DLC for free, you are hurting both the gaming industry and the employees of that company. If you went to work, and didn't get paid because someone came along and did your job for you for free, you would be pretty pissed.

    If you are going to complain about things, or peoples comments, try and use language that is appropriate to the argument, and not saying "fuck off" or "you suck". Do some research or reading, and try and say something intelligent. I know it is a grasp for a lot of people to do, but give it a shot, someone might actually give a damn as to what you are saying.

    i side with bethesda. interplay sold the creative rights. they belonged to the company not the creators themselves, so now that bethesda owns them thay can do what they want. Even is sueing wasn't necessary, it is completely within their rights. And PS3 users quit bitching about DLCs. Bethesda is a BUSINESS meant to earn MONEY not please YOU. So therefore; it is run like a business. They saw that releasing DLCs to Microsoft would be more profitable than Sony, especially because there are more Xbox 360 and PC users playing the game. be patient.

    I'm glad that Interplay doesn't reach to making a Fallout MMO. No Enclave soldier saying "ROFL I hav kill U, f***ing tribal, in UR as 11111" for me thanks.

    Concerning Bethesda...Skyrim (Elder Scrool V) will be a shit (well, if God hismself dosen't make a miracle).

    New Vegas by Obsidian...looks tempating, why not? It could be a good game with a REAL line, even with the F3 esthetic.

    That's... not really a bragging point. Bethesda is a really crappy company lately, and I think they should receive some BAD ink for their bully-tactics. Especially when Fallout was never THEIRS in spirit. Fallout 3 was a joke lacking any kind of creativity. They rode the coat-tails of Interplay and Black Isle and made a blockbuster smash-hit cookie-cutter game that doesn't even run most of the time. Fallout 3? More like The Elder Scrolls V: Crash to Desktop. Screw Bethesda...

    Oh lol... are you kidding me? I have never crashed in Fallout 1, Fallout 2, or Fallout Tactics... EVER. On x86 or x64 OS! I still have them installed! Intellectual Property isn't like a loaf of bread. It's like buying the the right to exclusively use the recipe FOR bread, and then turning out nothing but really shitty oatmeal... and that's EXACTLY what Bethesda did. No doubting their ownership, but calling their game "Fallout" is like me naming my dog "Car" and then trying to drive him to work.

    Interplay IS Fallout. Sorry, Bethesda can make all the attempts in the world but Fallout is gone now, probably forever.

    Check out the bugs section. There were plenty of bugs in the initial versions (especially FO2) that required you to reload an earlier save or didn't allow you to complete the game, in which case I think I'd rather have the game crashing. Also, when you went down the grave in Golgotha it did make the game crash... Just because it doesn't crash for you doesn't mean it doesn't crash... Personally FO3 has never crashed for me, but I don't think its flawless.

    Bethesda did every dirty trick in the book to try to kill Interplay. In no way does fallout trilogy OR FOR THAT MATTER FALLOUT SAGA! try to convince the consumer your getting fallout 3.
